Terms and Conditions

Welcome to ASCEND. By accessing our website, creating an account, using our services, booking a class, or participating in any activity organized by ASCEND, you agree to be bound by these Terms and Conditions. We recommend you read this document carefully before using our services.

1. Introduction

ASCEND offers premium indoor cycling, wellness, and community services in Cumbayá, Ecuador.

These Terms and Conditions govern the relationship between ASCEND ("ASCEND", "the Company", "we", or "our") and any person who uses our services, including:

• Website

• Booking platform

• ASCEND Clubhouse portal

• Events

• Physical facilities

• Products and merchandise

• Benefits offered through strategic partners

By creating an account, purchasing a class package, contracting a membership, or participating in any of our activities, you confirm that:

• you are at least 18 years old or have express authorization from your parents or legal guardians;

• the information provided is truthful and updated;

• you fully accept these Terms and Conditions.

2. Bookings, Cancellations, and No-Shows

Our booking system allows you to secure your bike for any of our scheduled classes.

Bookings can be made through our platform up to seven (7) days in advance.

Cancellation Policy

We understand that plans can change.

To avoid penalties and keep the corresponding credit, you must cancel your booking at least six (6) hours before the class starts.

If you cancel within the six hours prior (Late Cancel) or do not attend the class (No-Show):

• the class will be deducted from your package;

• there will be no right to a refund or replacement.

In the case of unlimited memberships, ASCEND may apply the economic penalty informed at the time of purchase.

3. Late Arrivals

In order to protect the safety of all participants and preserve the class experience, ASCEND may deny entry to any user who arrives once the session has started.

This measure seeks to prevent interruptions during the class and guarantee a uniform experience for the entire community.

In these cases, Late Cancel or No-Show policies will apply accordingly.

4. Purchases and Refund Policy

All class packages, memberships, products, merchandise, and services purchased are final and non-refundable.

Class credits:

• are personal;

• are not transferable;

• must be used within the validity period informed at the time of purchase.

ASCEND may modify the prices of its products, memberships, or services at any time.

Such modifications will not affect previously made purchases until the contracted period expires.

5. Health, Safety, and User Responsibility

Indoor cycling is a moderate to high-intensity physical activity.

By participating in our classes you declare that:

• you are in adequate physical and medical condition to exercise;

• you participate at your own risk;

• you have consulted a healthcare professional when required by your physical condition.

Likewise, you agree to inform ASCEND in advance about any injury, pregnancy, illness, medical treatment, or physical condition that could affect your participation.

The omission of such information will be the sole responsibility of the user.

The user acknowledges and accepts that all physical activity involves inherent risks, including personal injury.

Within the limits permitted by applicable law, ASCEND, its shareholders, collaborators, coaches, and suppliers will not be liable for injuries, accidents, or damages derived from sports practice, except in cases of intent or gross negligence when so determined by current legislation.

6. Personal Belongings

Each user will be responsible for the care of their belongings.

ASCEND will not be liable for loss, theft, misplacement, or damage of personal items within its facilities, including lockers, exercise rooms, common areas, and waiting areas.

7. Image Use

During classes, events, activations, or activities organized by ASCEND, photographs and videos may be captured for promotional, advertising, institutional, or communication purposes in digital and print media.

By participating in our activities, the user authorizes the use of their image for such purposes.

If a user does not wish to appear in photographs or audiovisual material, they must communicate it in writing to the ASCEND team at: info@ascend.ec, who will make reasonable efforts to respect such decision.

8. Wall of Fame and Recognitions

ASCEND may recognize sports milestones achieved by its members through initiatives such as the Wall of Fame, instant photographs, publications, or mentions on social networks.

Participation in these initiatives will be voluntary.

Any user may subsequently request the removal of their photograph or image from these spaces, without affecting their relationship with ASCEND.

9. ASCEND Clubhouse

ASCEND Clubhouse is an exclusive benefits network for active members.

The benefits offered through ASCEND Clubhouse are provided directly by allied establishments and brands.

ASCEND acts solely as a facilitator of said network and will not be liable for:

• availability of the benefits;

• quality of products or services offered by the partners;

• price changes;

• modifications in promotions;

• commercial conflicts between the user and a partner.

Each allied establishment will be responsible for providing its own products and services.

Benefits may be modified, updated, or terminated at any time without generating a right to compensation.

10. Behavior Rules

Our goal is to build a respectful, safe, and inclusive community.

All users must maintain appropriate behavior towards:

• coaches;

• collaborators;

• members;

• partners;

• facilities.

Any discriminatory, aggressive, offensive behavior, or behavior that affects the experience of other members will not be allowed.

The use of cell phones inside the studio during classes must be avoided to preserve the immersive experience.

ASCEND may request the immediate departure from the facilities or suspend the membership of any user whose behavior affects the safety, well-being, or coexistence of the community.

11. Right of Admission

ASCEND reserves the right to deny access or temporarily or permanently cancel the membership of any user who:

• breaches these Terms and Conditions;

• puts the safety of other participants at risk;

• causes damage to the facilities;

• maintains disrespectful behavior towards collaborators, coaches, or members.

12. Digital Platform

ASCEND makes reasonable efforts to keep its website, booking platform, and ASCEND Clubhouse portal available.

However, it does not guarantee the continuous availability of said services and will not be liable for interruptions caused by maintenance, technological failures, or third-party services.

13. Intellectual Property

All content belonging to ASCEND, including:

• commercial name;

• logos;

• designs;

• photographs;

• videos;

• texts;

• graphics;

• visual identity;

• website content;

• promotional material;

is the property of ASCEND or its respective owners and is protected by applicable intellectual property legislation.

Its reproduction, distribution, or use without prior written authorization is prohibited.

14. Modification of Terms

ASCEND may update these Terms and Conditions when necessary to reflect legal, operational, or commercial changes.

Significant modifications will be communicated through the website or any other official channel.

The continued use of our services after the publication of said modifications will constitute acceptance of the new Terms and Conditions.

15. Applicable Law

These Terms and Conditions will be governed by and interpreted in accordance with the current legislation of the Republic of Ecuador.

Any controversy related to the provision of our services will be resolved according to the competent jurisdiction of Ecuador.
